Terms of Service

Welcome to SoCal Longboard Rentals.

These Terms of Service (“Terms”) govern your use of the SoCal Longboard Rentals website and your rental of surfboards and related equipment from SoCal Longboard Rentals (“SoCal Longboard Rentals,” “we,” “us,” or “our”).

By submitting a rental request, renting equipment, or using our website, you agree to these Terms.

If you do not agree to these Terms, please do not use the website or rent equipment from us.

1. Rental Services

SoCal Longboard Rentals provides surfboard and related equipment rentals in Southern California.

The surfboards displayed on our website are subject to availability.

Rental prices and available rental periods are displayed on the website or communicated to the customer before a rental is confirmed.

Unless otherwise stated, the rental rate for our longboards is $75 per day.

2. Rental Requests Are Not Automatic Confirmations

A rental request submitted through the website is a request for availability. It is not, by itself, a confirmed rental.

After receiving your request, SoCal Longboard Rentals may contact you to:

  • Confirm the requested board is available

  • Confirm the requested rental dates

  • Confirm pricing

  • Arrange pickup and return

  • Obtain any additional information required

  • Complete payment arrangements

  • Complete required rental documents or waivers

A rental is not confirmed until SoCal Longboard Rentals has communicated confirmation to the customer.

3. Rental Eligibility

Renters must meet any applicable age and eligibility requirements established by SoCal Longboard Rentals.

SoCal Longboard Rentals may request identification or other information before releasing rental equipment.

The person renting the equipment is responsible for providing accurate information and for ensuring that anyone using the equipment is authorized to do so.

SoCal Longboard Rentals reserves the right to decline a rental when reasonably necessary for safety, equipment availability, legal compliance, or other legitimate business reasons.

4. Rental Period

The rental period begins at the agreed-upon pickup or delivery time and ends when the equipment is returned to SoCal Longboard Rentals or otherwise accepted by us.

The customer agrees to return all equipment at the agreed time and location.

Equipment may not be retained beyond the agreed rental period without prior approval.

Late returns may result in additional rental charges.

5. Pickup and Return

Pickup and return arrangements will be communicated when the rental is confirmed.

The customer is responsible for arriving at the agreed pickup location at the agreed time and returning the equipment as instructed.

If circumstances prevent the customer from returning equipment as scheduled, the customer should contact SoCal Longboard Rentals as soon as reasonably possible.

6. Payment

The website may be used to submit a rental request without making an immediate payment.

Once a rental request has been reviewed and confirmed, SoCal Longboard Rentals will provide instructions regarding payment.

The total amount due may include the rental fee and any applicable taxes, delivery charges, or other charges disclosed before the rental is finalized.

7. Cancellations

If paid in advance, full refunds will be given for cancellations made 48 hours before rental. For cancellations made less than 48 hours before rental, a 50% refund will be given. No refunds will be given for no-shows.

8. Weather and Ocean Conditions

Surfing conditions are unpredictable and may change rapidly.

Weather, swell, tides, currents, wind, water temperature, visibility, marine conditions, and other circumstances may affect whether surfing is appropriate or safe.

SoCal Longboard Rentals reserves the right to cancel or modify a rental when conditions create a reasonable safety concern or circumstances beyond our reasonable control prevent the rental from being provided.

Full refunds will be given for cancellation decisions made by SoCal Longboard Rentals. 50% refunds will be given for rentals cancelled by the customer based on their decisions about weather and water conditions. This does not include a customer’s unhappiness with the quality of the waves during their session, or the wind picking up. Those are conditions beyond our control.

Customers are responsible for determining whether current conditions are appropriate for their own skill level and experience.

A customer who chooses to surf despite unfavorable conditions does so at their own risk.

9. Customer Responsibility

Customers are responsible for the proper care and use of rental equipment.

Customers agree to:

  • Use the equipment only for its intended purpose

  • Follow reasonable instructions provided by SoCal Longboard Rentals

  • Take reasonable precautions to prevent damage or loss

  • Not intentionally or recklessly damage the equipment

  • Not lend, transfer, or sub-rent the equipment without permission

  • Not use the equipment for unlawful purposes

  • Return the equipment at the agreed time and location

  • Notify SoCal Longboard Rentals promptly of damage, loss, theft, or malfunction

10. Equipment Inspection

Customers should inspect the equipment at pickup and notify SoCal Longboard Rentals of any existing damage or condition that should be documented before use.

Existing damage identified before the rental begins will not be attributed to the customer.

Unless otherwise documented, the equipment is considered to have been provided in reasonable rental condition.

Normal wear and tear resulting from ordinary use is not considered customer-caused damage.

11. Damage, Loss, or Theft

The customer may be responsible for reasonable repair or replacement costs when rental equipment is damaged, lost, or stolen as a result of the customer's negligence, misuse, intentional conduct, unauthorized use, or failure to return the equipment.

Any damage or replacement charge will be based on the reasonable cost of repair or replacement, taking into account the condition of the equipment and applicable law.

The card used for payment will have a temporary hold charged equal to the value of the rental board.. The hold will be released upon safe return of the rental equipment. The held funds may also be used for any repair or replacement damages incurred during rental.

Customers should not attempt to repair damaged equipment without first contacting SoCal Longboard Rentals.

12. Surfing Safety and Assumption of Risk

Surfing and ocean activities involve inherent risks, including serious injury and death.

Potential risks include, but are not limited to:

  • Drowning

  • Serious bodily injury

  • Head injuries

  • Collisions with surfboards or other equipment

  • Collisions with other surfers, swimmers, vessels, or watercraft

  • Contact with rocks, reefs, sandbars, piers, or other objects

  • Strong currents and rip currents

  • Waves or surf conditions beyond a participant's ability

  • Changing weather and ocean conditions

  • Cold-water exposure

  • Marine life

  • Loss or damage to personal property

  • Serious injury or death

Customers are responsible for honestly evaluating their own swimming ability, physical condition, surfing experience, and skill level before using rental equipment.

Customers should never use rental equipment in conditions beyond their ability.

13. Separate Rental Agreement and Waiver

Before receiving rental equipment, customers may be required to sign a separate rental agreement, assumption-of-risk agreement, liability waiver, or release.

That document may contain additional terms concerning:

  • Assumption of risk

  • Release of claims

  • Indemnification

  • Equipment responsibility

  • Safety requirements

  • Emergency procedures

  • Minors

  • Medical conditions and emergency contacts

  • Other rental requirements

When a separate agreement is signed, its terms apply to the rental and will control over these website Terms to the extent of any conflict.

Nothing in these Terms is intended to waive a right or limit a liability that cannot legally be waived.

14. Limitation of Liability

To the maximum extent permitted by applicable law, SoCal Longboard Rentals will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or rental equipment.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

This provision does not replace or supersede any separate waiver or release signed by the customer.

15. Indemnification

To the maximum extent permitted by applicable law, customers agree to indemnify and hold harmless SoCal Longboard Rentals and its owners, employees, agents, and contractors from claims, damages, losses, liabilities, costs, and expenses arising from the customer's negligent, reckless, unlawful, or unauthorized use of rental equipment or violation of these Terms.

This provision does not apply to the extent prohibited by applicable law.

16. Website Use

You agree to use the SoCal Longboard Rentals website only for lawful purposes.

You may not:

  • Submit false or misleading information

  • Attempt to interfere with website operation or security

  • Attempt to gain unauthorized access to the website or its systems

  • Use the website to conduct fraudulent activity

  • Use automated systems to improperly access or collect information from the website

  • Reproduce or commercially exploit website content without permission

17. Website Information

We make reasonable efforts to keep website information accurate and current.

However, surfboard availability, rental pricing, photographs, descriptions, and other information may change.

SoCal Longboard Rentals reserves the right to correct errors and update website information at any time.

Photographs are intended to provide a general representation of rental equipment. Minor differences in appearance or condition may exist.

18. Third-Party Services

The website may rely on third-party services for functions such as website hosting, forms, payment processing, email, mapping, analytics, or other services.

Those third-party services may have their own terms and privacy policies.

SoCal Longboard Rentals is not responsible for the availability, security, or policies of third-party services.

19. Force Majeure

SoCal Longboard Rentals will not be responsible for delays, cancellations, or inability to provide a rental caused by circumstances beyond our reasonable control.

Such circumstances may include:

  • Severe weather

  • Unsafe ocean conditions

  • Natural disasters

  • Government restrictions

  • Equipment failure

  • Utility or internet outages

  • Transportation disruptions

  • Labor disruptions

  • Other unforeseen circumstances

When reasonably possible, we will notify affected customers and provide any refund, rescheduling, or other remedy required by our applicable policies or by law.

20. Disputes and Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute arising from these Terms or a rental transaction will be decided exclusively by SoCal Longboard Rentals.

21. Changes to These Terms

We may update these Terms from time to time.

When changes are made, we will update the Effective Date at the top of this document.

Changes to these Terms will not retroactively modify the agreed terms of an already-confirmed rental unless permitted by law or agreed to by the customer.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

23. Entire Agreement

These Terms, together with the customer's rental confirmation, any applicable rental agreement, waiver, release, and other documents expressly incorporated into the rental transaction, constitute the agreement governing the customer's use of the rental services.

If there is a conflict between these website Terms and a separately signed rental agreement or waiver, the separately signed agreement will control to the extent specified in that agreement.
